The short version
- A license runs one MiningOps site, at one domain, with as many rigs as your server handles.
- It includes every release published during your year of updates, and you can keep and reinstall those for good.
- MiningOps runs on your server and does what you tell it. Your rigs, settings, power and earnings are your responsibility.
- If it doesn't work out, ask within 7 days of buying for a full refund. A refunded site's dashboard is switched off; its rigs keep mining.
- The software comes as it is, and our liability is limited to what you paid us in the last 12 months.
This summary helps you read what follows. The numbered sections are what apply.
These terms
These terms are an agreement between you and Adpath, Inc. ("we" or "us"), which makes and sells MiningOps. They cover this website, license keys, the MiningOps software (the dashboard and the agent that runs on your rigs) and its updates.
You accept them when you buy a license, install MiningOps, or sign in to your license page. If you accept them for a company, you confirm you can do that for it, and "you" means the company. You must be at least 18.
Your license
Once you've paid, we send you a license key. It lets you install and run MiningOps on one site, at one domain, for your own mining, at home or as a business. There's no limit on the number of rigs, cards or ASICs.
The license is yours alone: it isn't exclusive, and you can't transfer it without our written agreement. We keep every right in MiningOps that these terms don't give you.
If you set up or run MiningOps for other people, each of their sites needs its own license.
Updates
Your license includes every release we publish until its updates-until date, which is one year after you buy unless we agree otherwise. Renewing adds a year to that date, or to today if it has passed, under the same key.
When your updates end, your site keeps running on the version it has, and you can reinstall any release your license covered. We don't promise a release schedule or particular features, and a release may change or remove features.
Keys and your license page
Keep your key private. Anyone who has it can sign in to your license page and register a site with it. If your key is lost or leaked, write to support@miningops.io and we'll replace it; the old key stops working.
A key belongs to the first domain that registers it. To move to a new domain, release the old one on your license page first. Running the installer on a new server with the same domain moves the license there, and the old server's update checks stop working.
What you may not do
- Share or publish your key, or run more sites than you have licenses.
- Sell, rent, sublicense or give away MiningOps or a license, unless we agree in writing.
- Get around or switch off the license check, the signature checks on updates, or the lock a refund puts on a site.
- Publish or distribute the MiningOps code, changed or not.
- Mine on hardware or power you don't have permission to use, or use MiningOps for anything unlawful.
- Use this website or the license service in a way that harms them or other customers, for example by overloading them or guessing keys.
You may read the code on your own site and change it for your own use. We can't support a changed install, and an update may overwrite your changes.
Buying, renewing and refunds
We sell licenses by email at sales@miningops.io for now. We tell you the price before you pay, and send your key once your payment arrives. Prices are in US dollars unless we agree otherwise, and you pay any sales or similar taxes that apply.
If MiningOps doesn't work out for you, write to sales@miningops.io within 7 days of buying or renewing for a full refund of that payment. When we refund a purchase, we disable its key and switch off the site it runs, as the next section describes. A payment that is reversed or charged back does the same until it is settled.
Switching off a refunded site
When we refund a purchase, or a payment for it is reversed or charged back, we switch off the MiningOps site that license runs, from a distance. We send it a notice signed with the same key as our releases, and your site checks that signature itself. At its next daily check-in it locks its dashboard: every page then says the license was refunded or the payment reversed, and alerts stop going out.
Your rigs keep mining on their last settings, and nothing on your server is deleted. When a reversed payment is settled, we send a second notice that unlocks the site.
We send these notices only after a refund or a reversed payment, never to settle any other disagreement. By buying a license, you agree that a refunded site can be switched off this way.
Mining is at your own risk
MiningOps does what you tell it to on your rigs. It can start and stop miners, switch coins, pools and wallets, and change clocks, power limits and fans. Settings like these can make cards unstable or hot, shorten their life or damage them, and a wrong wallet or pool address can send earnings where you can't get them back. You decide what to change, and you're responsible for your hardware, its cooling and electrical supply, and checking what MiningOps does before you rely on it.
Profit, earnings, cost and power figures are estimates built from pool reports, coin prices, network difficulty and power readings that come from other sources. They can be late or wrong. They aren't financial, investment or tax advice, and coin prices can fall fast. Whether mining pays is your call.
Alerts can arrive late or not at all, for example when a rig, your server, your network or a messaging service is down. Don't rely on MiningOps as your only protection against heat, fire or electrical faults.
You're responsible for following the laws, tax rules, and utility, lease and building rules where you mine.
Your server and your data
Your MiningOps site runs on a server you control, and its data stays there. We can't see it, and we can't recover it if it's lost. You're responsible for the server, its security, the accounts you give people, and your own backups. MiningOps copies its databases before each update, which helps but doesn't replace your backups.
Other software and services
MiningOps works with software and services we don't control: the mining programs it installs, which have their own licenses and developer fees, mining pools, coin price and difficulty sources, Cloudflare, power monitors, and messaging services such as Telegram and Discord. Their own terms apply when you use them. They may change or stop working with MiningOps, and we aren't responsible for them, though we work to keep MiningOps working with the ones it supports.
Support
Support is by email at support@miningops.io. We answer as soon as we reasonably can, but we don't promise a response time unless we've agreed one with you in writing.
No warranty
MiningOps, this website and the license service are provided "as is" and "as available". As far as the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any promise that MiningOps will run without interruption or errors, or that it will make you money.
Some states don't allow some of these exclusions, so they may not all apply to you.
Limits on our liability
As far as the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost or misdirected cryptocurrency, lost data, damaged hardware or power costs, even if we were told they might happen. Our total liability for any claim about MiningOps or these terms is limited to what you paid us for MiningOps in the 12 months before the claim arose.
These limits apply whatever the legal theory. Some states don't allow some of them, so they may not all apply to you.
Claims from others
If someone makes a claim against us because you broke these terms or used MiningOps unlawfully, you'll cover our reasonable costs of dealing with it, including legal fees and any amount we have to pay.
Ending a license
You can stop using MiningOps at any time. We may disable your license if you seriously break these terms, for example by sharing your key. We'll tell you why by email and, where it can be put right, give you 14 days to do so first, unless it's putting us or other customers at risk. When a license ends, you must stop using MiningOps.
If we stop selling MiningOps or running the license service, we'll email license holders first. Installed sites keep running on the version they have.
The sections on mining risks, warranty, liability, claims from others, and governing law keep applying after a license ends.
Governing law and disputes
The laws of the United States and of the state where our principal office is govern these terms, without regard to conflict-of-law rules. Before you file a claim, write to us and give us 30 days to try to settle it. Any lawsuit goes to the state or federal courts for the county where our principal office is, and you and we agree to their jurisdiction. Either of us may bring a claim in small claims court if it qualifies.
Export rules
You may not use MiningOps in, or send it to, a country or person under US sanctions or export restrictions, and you confirm you aren't on a US government list of restricted parties.
Changes to these terms
We may update these terms. We'll change the date at the top, and for a change that matters, email license holders at least 30 days before it applies. A change never takes away a release your license already covers. If you keep using MiningOps after a change applies, the new terms apply to you.
The rest
These terms, with anything we agree in writing when you buy, are the whole agreement about MiningOps. If a part of them can't be enforced, the rest still applies. If we don't enforce a term, we haven't given it up. You can't transfer these terms without our agreement; we can transfer them to whoever takes over MiningOps.
